Randy Thomasson on Prop. 8 Hearing at U.S. Supreme Court
While judges struggle to obey the Constitution, Americans in touch with reality should consider why marriage exclusively for a man and a woman benefits children
Sacramento, California -- A leading family-values organization in California is glad that the U.S. Supreme Court has the opportunity to discover that marriage is not in the U.S. Constitution and that states' right are, and therefore decide to uphold California's Proposition 8.
"Prop. 8 at the Supreme Court is an opportunity for Americans in touch with reality to think about the God-given differences between male and female, the requirement of a man and a woman for procreation, the natural physical match of a husband and wife, and the fact that children do best with a married father and mother under the same roof," said Randy Thomasson, president of SaveCalifornia.com, which promotes moral virtues for the common good.
"The concerning part about the Prop. 8 hearing was the justices' subjective feelings and personal agendas trumping strict loyalty to the plain, written words of the Constitution and their original intent," Thomasson said. "Judicial activists who don't care what the Constitution says or doesn't say are the problem. Californians need the Supreme Court to realize that marriage isn't in the Constitution, but that states' rights are, and that the court should uphold Proposition 8 as the honorable public policy of the People of California."
With full recognition that Prop. 8 could come down to the vote of Justice Anthony Kennedy, Thomasson said, "Kennedy is correct that it would be 'uncharted waters' for the high court to expand homosexual 'marriages' by judicial fiat. In fact, it would be unconstitutional. Kennedy is also correct to affirm there is a wealth of evidence that children do best when raised by a married father and mother." Concerning the recent impact of same-sex "marriages" upon children compared to the long-standing plethora of evidence demonstrating the benefits of a child having a married father and mother, Kennedy opined, "We have five years of information to pose against 2,000 years of history."
"The liberals on the U.S. Supreme Court are trying to get Prop. 8 struck down on a standing issue," Thomasson observed. "But this subversive strategy to force homosexual 'marriages' upon California shouldn't fly. The extraordinary permission granted the Prop. 8 campaign to directly appeal their case to the nation's high court was bestowed by the California Supreme Court, as well as the 9th Circuit Court of Appeals, because of the extraordinary dereliction of duty by current Governor and former Attorney General Jerry Brown, current Attorney General Kamala Harris, and former Governor Arnold Schwarzenegger -- all refusing to perform their sworn duties to defend Prop. 8 and appeal it if necessary. The Prop. 8 campaign's standing as a party in this case is completely justified. For without standing, there is no chance for justice, no representation of the People, and our California Republic cracks apart all the more."
"The justices have a simple question before them, and the ruling is also simple when you abide by the written Constitution," Thomasson said. "First, marriage not in U.S. Constitution. Second, the 14th Amendment, which is not about marriage but about race, and not about couples but individuals, does not apply to Prop. 8. Third, the 10th Amendment recognizes states have powers that are not federal powers and that are not prohibited by the Constitution. Fourth, Article IV, Section 4 of the U.S. Constitution guarantees a republican form of government to each state, where a written constitution is the supreme law of the state. Fifth, the California Constitution contains Proposition 8 as Article 1, Section 7.5. Therefore, Prop. 8 should be upheld."
Thomasson has been defending marriage rights for man-woman marriage since 1994. Together with Liberty Counsel, SaveCalifornia.com filed an amicus brief supporting Prop. 8 with the Supreme Court.
